1. Scope

These terms of use apply to the use of the website handy-abo.com, operated by MARKTIX AG, Sinserstrasse 65, 6330 Cham (the “operator”). By accessing the website, the user accepts these terms.

2. Description of services and brokerage model

handy-abo.com is an independent comparison portal for mobile and Internet subscriptions in Switzerland. MARKTIX AG provides comparison information and, at the user’s express request, brokers contracts with mobile and Internet providers.

The process is as follows:

• Comparison: The user compares offers on the platform without any obligation.
• Non-binding offer: The user can request a non-binding offer. This has no legal effect and does not oblige the user to anything.
• Binding conclusion of contract: If the user clicks “Conclude contract” and confirms the subsequent authorisation step, they expressly grant MARKTIX AG the authority to conclude a contract with the chosen provider on their behalf. The contract exists directly between the user and the provider; MARKTIX AG acts as broker and representative of the user.
• Remuneration: MARKTIX AG receives a brokerage commission from the respective provider. This has no influence on the price payable by the user.

Once the contract has been concluded, the user receives a confirmation by email. Only the provider’s own terms and conditions are decisive for the content of the contract.

3. No contractual partnership

MARKTIX AG is not a party to the contracts concluded between user and provider. It accepts no liability for the content, conditions or performance of those contracts.

4. User reviews

Users can post reviews of providers. The operator may remove reviews without giving reasons, in particular if they are offensive, untrue or unlawful. There is no entitlement to publication. By submitting a review, the user grants MARKTIX AG an unlimited right of use to that content in time and territory.

5. Newsletter

The newsletter service requires express consent (double opt-in). You can unsubscribe free of charge at any time via the unsubscribe link in the newsletter.

6. Call-back and advisory service

The operator offers a free call-back and advisory service. It is non-binding and does not create a contractual relationship. MARKTIX AG reserves the right to restrict or discontinue this service at any time.

7. Availability

The operator aims for high availability but gives no guarantee of uninterrupted operation. Maintenance work may take place at any time without prior notice.

8. Limitation of liability

MARKTIX AG is liable only for damage caused intentionally or through gross negligence. No liability is accepted for indirect damage, lost profit or data loss.

9. Changes

The operator reserves the right to change these terms of use at any time. Changes are published on the website. Continued use after a change is deemed acceptance.

10. Withdrawal / cancellation

For cancellation, withdrawal or rescission options, only the conditions of the respective provider apply.

11. Severability clause

Should individual provisions of these terms of use be or become invalid, the validity of the remaining provisions remains unaffected.

12. Applicable law

Swiss law applies exclusively. Place of jurisdiction is Zug.
